Before that, Walworth County usually issues the zoning permit and, off public sewer, the sanitary permit. Cities and villages such as Elkhorn, Delavan or Lake Geneva run their own permit desks, and the Town of Bloomfield zones for itself.

Walworth County's home-building brochure tells prospective owners to check with the individual towns for building code and building permit requirements. The county's list of town building inspectors, dated May 2026, names an inspector for each town; several inspectors cover more than one town, so the Towns of Delavan and Geneva share the same one.

County zoning coverage
Walworth County administers a General Zoning Code and a Shoreland Zoning Code, both in Chapter 74. The general code covers town land everywhere except the Town of Bloomfield. Elkhorn, Fontana and Williams Bay hold extraterritorial zoning over some nearby town land, and inside those areas the county has no zoning jurisdiction.

Shoreland zone
The county's Shoreland Zoning Code applies to town land within 1,000 feet of a lake, pond or flowage, or within 300 feet of a river or stream or the landward edge of the 100-year flood elevation, whichever is greater. The county posts a separate waterfront zoning permit for these lots.

Walworth County's brochure says its zoning ordinances, first adopted in 1974, reach single-family dwellings, accessory structures such as garages and sheds, and agricultural barns. In shoreland areas they also cover retaining walls, patios, walkways, tree cutting and any land disturbance.

Walworth County Land Use and Resource Management issues all sanitary permits in the county and inspects every septic system installation. The Town of Linn, on the north and south shores of Geneva Lake, steers new homes toward the lake and names the county zoning districts that fit: R1 Single Family Residential, with lots of 40,000 square feet and 150 feet wide, and A2 Agricultural Land, which requires 20 acres and 300 feet of frontage on a public road.
