The Winnebago County Zoning Department issues county zoning, sanitary and erosion control permits in the towns of Algoma, Neenah, Nekimi and Omro (Omro issues its own erosion control permits). The towns of Black Wolf, Clayton, Nepeuskun, Oshkosh, Poygan, Rushford, Utica, Vinland, Winchester, Winneconne and Wolf River keep their own zoning jurisdiction for zoning permits.

Shoreland area
Winnebago County defines the shoreland area as land within 1,000 feet of a lake, pond or flowage or 300 feet of a navigable river or stream, extended to the landward side of the floodplain where that applies. The county has jurisdiction over rural shoreland areas for zoning, sanitary and erosion control permits, including in towns with their own zoning.

Minimum lot size
Per the county zoning office, newly created residential lots generally need 9,000 to 15,000 square feet where sewer is available and 20,000 to 43,000 square feet where it is not. Existing lots of record below the minimum may still be built on if all setbacks are met.

Septic permits
The Winnebago County Planning and Zoning Department regulates every private onsite wastewater treatment system in the county, alongside municipal sewers and several town sanitary districts. The county says complete sanitary permit applications take two to three days to process, and it requires maintenance and inspection of all septic systems.

Wetlands and floodplain
Winnebago County has adopted wetland maps for the whole county; wetlands smaller than two acres are not mapped, and wetlands cannot be filled regardless of size. Building in a floodplain is allowed with restrictions, building in a floodway generally is not, and removal from the floodplain for insurance does not remove a lot for construction purposes.
